Following Will from typewritten notes of my great-grandmother Rozina Fairchild Davis in 1923 taken from certified copy she obtained:

WILL OF THOMAS DAVIS

Maryland SCT:

     In the name of God Amen, I Thomas Davis Senr. of Ann Arundel County and Prvince Afsd. Planter being in perfect health thanks be to God, do make this my last will and testament in manner and form following, Viz: Imprimis, I give and bequeath unto my loving wife Mary Davis, (after my just debts and legacies mentioned in the following will afs paid) all my personal estate to be by her possessed during her widowhood.

     Item --- I give unto my grand son Caleb Davis son of Richard all that tract of land whereon his mother now dwells being part of a tract of land called Duvalls Delight containing two hundred acres to be possessed by him his heirs and assigns forever, but my will is that his mother Viz. Ruth Davis shall possess the said tract without any interruption or molestation whatsoever during her widowhood.

     Item --- I give to my son Thomas two hundred acres of land called Laswells Hopewell, to be possessed by him his heirs and assigns forever.

     Item --- I give to my son John two tracts of land, the one called Davistone containing two hundred and forty acres, the other called What's Left adjoyning to the said Davistone, containing one hundred acres to him his heirs and assigns forever.

     Item --- I give to my son Samuel two parcels of land lying in Prince Georges County, the one called the Forest containing fifty acres, adjoyning to the said sixty either acres, tohim his heirs and assigns forever.

     Item --- I give to my son Robert all that parcel of land, being part of a tract called Ranters Ridge, containing three hundred and fifteen acres (with one negro boy named Harry) to him the said Robert his heirs and assigns forever.

     Item --- I give to my son Francis two parcels of land, the one called the Pearl, being part of a tract called the Diamond, containing one hundred and fifty acres, the other called now Davis's Addition, being part of a tract called Grimestone, containing two hundred acres, to him his heirs and assigns forever, as also one negro boy named Hector, three pair of Hand-irons belonging to the house where I now dwell, two pair of iron Pt-racks, three pair of Tons and a fire shovel.

     It is my will and desire that whatever part of my estate my children have received hereto, or shall receive before my death, shall not after my death be deemed or appraised as part therof.

     Lastly --- I do hereby constitute my loving wife Mary together with my sons John and Francis Executors of this my last will and testament, and what shall be remaining of my personal estate in my wifes possession, my will is that after her decease it be equally divided amongst my ten children Viz. five sons and five daughters, hereby revoking all other wills heretofore by me made, ratifying and Confirming this only as my last will and testament.

     IN TESTIMONY whereof I have hereunto set my hand and affixed my seal this twentieth day of January in the year of our Lord God one thousand seven hundred and forty three and four.

ON THE BACK OF THE AFOREGOING WILL WAS WRITTEN VIZ:

On the 24th day of May 1749, John Sappington and Richard Sappington two of the subscribing witnesses to the within will being duly and solemnly sworn on the Holy Evangels of Almighty God severally deposed and said that they saw the Testator Thomas Davis sign and seal the said will and heard him publish and declare the same to be his last will and testament that at the time of his so doing he was to the best of their judgment and apprehension of sound and disposing mind and memory and that he the said John Sappington made his mark and the said Richard Sappington subscribed his name as witnesses to the said will in the prsence of the said testator and at his request.

     I hereby certify that the aforegoing is a true copy of the Last will and Testament of Thomas Davis Senr. of Anne Arundel County, as taken from Book No. 26, folio 138, of the will Records one of the original Will Books on file in this Office.
