WILL OF COL. RICHARD DAVIS (1787)

In the Name of God, Amen.
I, Richard Davis Senior of Washington County and State of Maryland being sick and weak in body, but of sound disposing mind, memory and understanding praised be to God for the same and being desirous to settle my Worldly Affairs whilst I have strength and Capacity so to do, do make and publish this my last Will & Testament, hereby revoking and making void all former Wills by me at any time heretofore, ade, and first & principally I commit my Soul unto the of my Creator who gave it and my body to the Earth to be intered at the discretion of my Executors hereinafter named, and as to such Worldly Estate as it hath pleased God to intrust me I dispose of hte Same as followeth
First I give and bequeath unto my beloved Wife Rachel Davis for and During her Natural life in lieu and as a Consideration of her Dower or third part of my Estate, the Lease of Land which I now hold and live on, all my house hold and Kitchen furniture two negro Slaves Arthur and Lid and their future increase and Also all my Stock of Horses, Cattel, Hogs & Sheep together with their future Increase, except such part as I may Otherwise direct the Disposal of by this my last Will. --- and at the Deceaser fo my said Wife my Will & Desire is that my son Isaac Davis his heirs Executors and Administrators forever shall have and enjoy all the above mentioned property with their Increase as aforesaid.
Secondly I give and bequeath unto my Son Amos Davis his heirs Executors and Administrators forever a Negro Girl Slave Called Amy with her future Increase.
Thirdly I give and bequeath unto my son Rezin Davis in trust for the use Benefit and support of my Son Danus
Davis his heirs Executors and Administrators forever two Negro Slaves Harry & Jacob but in case my said Son Darius should die Without Issue lawfully begotten my Will and Desire then is that my son Regin
his heirs Executors and Administrators forever shall have the said two Negros Harry & Jacob.
Fourthly I give and bequeath into my son Dennis Davis his heirs Executors and Administrators forever a Negro Slave called Joshua.
Fifthly I give and bequeath unto my son Albinus Davis his heirs Executors and Administrators forever a Negro Slave called Ignatius.
Sixthly I give and bequeath unto my Said Son Isaac Davis his heirs Exescutors and Administrators forever exclusive of the property given him in the forepart of this my last Will a Negro Slave called Moses and Also half a Dozen Silver Table Spons marked I.D.
Seventhly I give and bequeath unto Elizabeth Davis, Regin
Davis and William Davis (Children of my son Richard Davis) to them and their heirs Executors and Administrators forever a Negro Slave Called Daniel or the value of him is to be devided
Among the above Mentioned three Children of my Son Richard equally, or the Survivor or Survivors fo them when teh Youngest shall arrive at the age of Twenty One Years in case they Cannot agree about the manner of Dividing the Value of the said Negro Daniel he is to be sold by the eldest which may be then living at public Vendue at the period above mentioned when the Youngest of them which may be living shall arrive to Lawful age, and until that time my son Richard is to take care of the said Negro Daniel.
Eightly I give and bequeath unto my niece Ruthy Davis who now lives with me a Heifer Called Starr, and also two Ewes and two Lambs together with their future Increase to her her Heirs Executors and Administrators forever.
Ninthly as Administrator of the Estate of Joshua Davis deed, I am indebted to his two Sons Joshua Davis & Caleb Davis for their dividends of said Estate, In order to discharge the same my Will & Desire in that my Executors shall sell as much of my Stock as will Amount to and discharge the same.
Tenthly I devise and bequeath all the Rest and Residue of my Estate of what kind Soever, to my said Wife for and During her natural life, and at her Decease to my Son Isaac Davis his heirs Executors and Administrators forever.
Lastly I do hereby constitute and Appoint my beloved wife Rachel Davis my said Sons Amos Davis and Rezin Davis to be my Executors of this my last Will and Testament revoking and annuling
all former Wills by me heretofore made ratifying and confirming this and none Other to be my Last Will and Testament. In testimony whereof I have hereunto set my Hand and affixed my Seal this twentyeth day of March in the Year of our Lord One thousand Seven Hundred and Eighty Seven.

WASHINGTON COUNTY, Ss/ On the 26 day of February 1788 Came Rachel Davis & Rezin Davis & made Oath that the within Instrument of Writitng is the true & whole Will & Testament of Richard Davis Senr. late of said County Decesd
that hath some to their hands or possession & that they do not know any Other. And at the same time came James Clark & Joseph Clark two of the subscribing Witnesses to the Will & Testament of Richard Davis Senr late of said County Decsd
& severally made Oath on the holy evangels of Almighty God that they did see the Testator therein named Sign & Seal this Will that they heard him publish pronounce & declare the same to be his last Will & Testament that at the time of his so doing he was to the best of their Apprehentions
of Sound & Disposing Mind Memory & Understanding & that they respectively subscribed their names as Witnesses to this Will in the presence & at the request of the Testator & in the presence of each Other.
